Biography

Attorney David A Kaufman is a native of San Diego, California. He grew up in the Point Loma area and attended the Bishops School for High School. For undergrad, David attended Williams College in Williamstown, MA, but the brutally cold east coast winters drove him back to Claremont McKenna College in southern California where he graduated in 2001 with a BA in history. Writing was always David's strongpoint, and he contemplated a career in professional writing during and after college.

After graduating from college, David tried his hand at freelance writing and screenwriting but ultimately settled for a 9-to-5 job working for a real estate and property management firm in San Diego. Following a year or so working in real estate and property management, David took the LSAT, did well, and applied to law schools all over the country, eventually selecting the University of Wisconsin Madison School of Law. During Law School at UW Madison, David particularly liked Torts and Contracts, as well as Insurance and Corporate Law. Unsure of his career path within the law and not seeing himself as a cog within a big law firm, David took time off to trying working in the construction industry to learn that business and skill set and explore the possibility of getting involved in the construction and remodel component of real estate and property management business. After working in construction for a spell, David returned to law school and graduated from UW Madison in 2009.

He returned to construction business briefly following graduation, looking at building a business that fixed and flipped houses, however, he did not ultimately pursue that. In 2011, David began providing contract legal services (drafting pleadings, motions, and discovery, etc.) for law firms and solo attorneys that represented clients in criminal matters, juvenile criminal cases, and personal injury cases, as well working on estate planning and commercial business planning matters.

On November 15, 2012, David was admitted to practice law in California. Soon thereafter David explored the possibility of moving into healthcare law and administration, and pursuant to that took a position with UCSD Healthcare Contracting Department and then parlayed that into a position working with Managed Care Contracting at Rady Children's Hospital. In 2016 David transitioned from managed care contracting to revenue cycle and health plan payment denials. While working at Rady Children's Hospital, David began taking civil litigation cases, first in employment and then in personal injury.

In the spring of 2017 David joined Consumer Attorneys of San Diego (CASD), networking with small practices and solo attorneys that represented plaintiffs. In June of 2017, David left Rady Children's and the healthcare industry to begin practicing civil litigation, at first performing contract work for various personal injury firms and attorneys in San Diego. David would perform contract litigation services for other attorneys up until the end of 2017, while simultaneously developing his own book of business in employment and personal injury. In late 2017 David also joined the Consumer Attorneys of Los Angeles (CAALA), the largest plaintiff's attorney organization in the US, which provided the opportunity to network and benefit from that organization's wealth of professional resources.

In January 2018, David went out on his own and launched the Kaufman Firm, with the firm's focus on representing plaintiffs in personal injury and employment cases. At that time David operated the firm out of his condo at 3162 Via Alicante Unit E in La Jolla, CA 92037. Later in 2019 the Kaufman Firm began taking on insurance litigation (insurance bad faith cases), while continuing to focus on employment cases, particularly discrimination, retaliation, and wrongful termination, as well as personal injury cases. Within the area of personal injury, the Kaufman Firm, assisted clients with auto collision personal injury cases, premises liability (slip & fall and trip & fall) cases, medical malpractice and dental malpractice cases, and product liability cases.

In June of 2019, the Kaufman Firm became the Law Offices of David A Kaufman, APC, incorporating and registering with the California Secretary of State. The focus of the practice switched more towards personal injury, but the firm continued to take on employment cases and some general civil litigation matters, as well.

In November of 2021, the Law Offices of David A Kaufman moved its offices location to 7752 Fay Ave Suite G in downtown La Jolla, where it currently runs the practice. The focus of the firm's practice continues to be representation of plaintiffs in personal injury and employment cases, as well as representation of clients in general civil litigation matters, such as commercial disputes, disputes involving real estate transactions, probate court actions involving trusts, and insurance litigation.

The Law Offices of David Kaufman remains dedicated to representing clients that have been injured by the negligent or intentional acts of another, as well as those that have been wrongfully terminated, or otherwise have suffered injustice. David A Kaufman is committed to fighting relentlessly to help underserved and underrepresented victim seek justice and to hold those at fault for wrongdoing accountable for full justice and fair compensation. The firm works tirelessly to achieve superior results for its clients.

The Law Offices of David A Kaufman takes most of its cases on a contingency basis. A contingency fee is a form of payment to a lawyer for their professional legal services that in contrast to a fixed hourly fee, entails a contingent fee arrangement whereby the lawyer receive a percentage of the monetary amount that the client receives when they win or settle the case. In a contingency fee agreement, the lawyer only receives compensation if the lawyer has successfully represented the client, obtaining a recovery from the defendant or insurer. Contingent fee arrangements generally offer many benefits to the client: (1) improved access for indigent clients by enabling people who could not otherwise afford counsel to assert their claims; (2) providing an incentive for attorneys to seek and maximize client recovery; and (3) enabling clients to shift risk of losing to the lawyer. This is a risk and business model that improves access to justice and means that a client's case will never be rejected because the client does not have the means or resources to pay for an attorney or finance litigation, although it does mean that in assuming risk and accepting a fee on a contingent basis, the Law Offices of David A Kaufman must carefully assess liability and determine that the facts and likely evidence would support a finding in the plaintiff's favor on the liability issue, as well as a valuation of damages that would warrant taking the case. This is all part of the careful vetting process to take steps to ensure that in taking on a case the Law Offices of David A Kaufman will be doing everything that it can to maximize the chances of the client's eventual and ultimate success.

In David's downtime, when he is not working to obtain justice for his clients, he enjoys outdoor activities and staying fit by participating in activities like bodysurfing the reefs and beach breaks of La Jolla, organic gardening, hiking, and working out.
